Dear Ms. Kearney: In your letter dated February 20, 2002, on behalf of your client Berwick Industries, LLC, you requested a classification ruling. You have submitted two samples of banners with the words “Seasons Greetings” and “Happy Halloween”. Photographs of “God Bless America”, “An American Flag” and the “Statute of Liberty” were submitted. Your letter of inquiry states that several themes will be depicted on the banners. The banners are composed of 62 percent polyethylene and 38 percent acrylic flocking. The applicable subheading for the “Seasons Greetings” banners will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for Articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Other: Other. The rate of duty will be free. The applicable subheading for the “Happy Halloween” banners will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for Festive, carnival and other entertainment articles: Other: Other. The rate of duty will be free. The applicable subheading for the “God Bless America”, “An American Flag” and the “Statute of Liberty” banners will be 3926.40.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for Other articles of plastics and articles of other materials of headings 3901 to 3914: Statuettes and other ornamental articles. The rate of duty will be 5.3 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
