Box 3165 Harrisburg, PA 17105 RE: The tariff classification of Christmas decorations from China. Dear Ms. Aldinger: In your letter dated May 9, 2001, you requested a tariff classification ruling. You have submitted samples and photographs of three 36-inch standing Christmas decorations. Each style is composed of 45 percent tricot, 15 percent plush fabric and 40 percent plastic. Each style breaks apart into three pieces for transport, head, body and torso. Each style has a plastic frame pieced together with metal screws. Style number 997361 is a Santa dressed in the traditional red and white suit, red and white hat, green gloves and black boots. Style number 997362, depicts a snowman wearing a blue jacket, red and green plaid scarf and a black hat. He is holding a broom. A sprig of holly leaves and berries is in his hatband. Style number 997363 depicts a reindeer wearing a red shirt with a plaid vest, green pants, green scarf with a bell on each end. Holly leaves and berries are placed at the base of his right antler. The applicable subheading for Christmas decorations, style numbers 997361, 997362 and 997363, will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for…articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: other, other. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
