Dear Mr. Hoffacker: In your letter dated March 13, 2001, on behalf of Consolidated Stores, Inc. of Columbus, Ohio, you request a tariff classification ruling. The sample that you submit, Item #HX1824, Metal Christmas Candleholder, consists of three designs of metal candleholders. The first, Santa, depicts a bearded Santa Claus face wearing a Santa hat decorated with holly leaves and holly berries that measures approximately 14” in height and 10” in width and has holes in lieu of eyes and a mouth. It is attached to a metal circular stand that measures approximately 1/4” in height and 10” in diameter. The stand has a upright metal pin for insertion of a candle which will emit light through the holes in the Santa’s eyes and mouth. The second, Snowman, depicts a snowman’s face wearing a hat decorated with holly leaves and holly berries that measures approximately 14” in height and 10” in width and has holes in lieu of eyes and a mouth. It is attached to a metal circular stand that measures approximately 1/4” in height and 10” in diameter. The stand has a upright metal pin for insertion of a candle which will emit light through the holes in the snowman’s eyes and mouth. The third, Reindeer, depicts a reindeer’s face that measures approximately 14” in height and 10” in width and has holes in lieu of eyes and a mouth. It is attached to a metal circular stand that measures approximately 1/4” in height and 10” in diameter. The stand has a upright metal pin for insertion of a candle which will emit light through the holes in the reindeer’s eyes and mouth. The applicable subheading for Item #HX1824, Metal Christmas Candleholder (Santa, Snowman, Reindeer) will be will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for festive...articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: other, other. The duty rate will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
