Dear Ms. Antrim-Saizan: In your letter dated July 3, 1997, you requested a tariff classification ruling on a Barbie Christmas tree ornament, item number 9702896. The ornament in question, is described as a Barbie decoupage ornament with a wooden stand. It consists of two items. The first item is a 3 1/2" diameter plastic ball with a gold tone cord attached to the top for hanging. The second item is a wood base measuring 3 3/4" in diameter with an 8" hooked wire extending from its base. The stand is designed for the ornament to hang from. The ornament and the stand are packaged together as a set in one retail container. The essential character of this set is the Christmas tree ornament. The applicable subheading for the Christmas tree ornament will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: other: other. The rate of duty will be free. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
