McClintic, Corporate Logistics Compliance Analyst Freudenberg-NOK 11617 State Route 13 Milan, OH 44846-9725 RE: The tariff classification of automotive parts from an unspecified country Dear Ms. McClintic, In your letter dated September 17, 2009, you requested a tariff classification ruling. The parts under consideration have been identified as a "Pinion Seal Sleeve" (Part # 1002423827200) and a "Pinion Seal Inner Component" (Part # 1002423969904). You state in your ruling request that the parts are wear sleeves used to prepare axle end yokes for sealing. They include a metal portion, made of 1008 cold-rolled steel, which forms a journal and molded rubber portions, made of 70 durometer ACM, that engage the axle end yoke and retain the sleeve to the yoke to keep contaminants from entering the radial shaft seal and axle. The sleeves are coated with grease (polyurea type) that serves to prevent corrosion and provides lubrication for the portions that will engage the radial shaft seal in sliding contact. Both parts are used in the front and rear drive axles of light trucks. The applicable classification subheading for the Pinion Seal Sleeve (Part # 1002423827200) and Pinion Seal Inner Component (Part # 1002423969904) will be 8708.99.6890, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Parts … of … motor vehicles … : Other parts … : Other: Other: Other: Other: Other parts for power trains: Other.” The general rate of duty is 2.5%.
