Dear Ms. Boullet: In your letter dated August 7, 2008, you requested a classification ruling. The submitted sample will be returned as per your request. Style WL6350 is a woman’s jacket constructed of a 100% polyester fabric that has been brushed on the inside surface. The garment features a full front opening with 5 large toggle closures, an oversized rib knit collar, a neck warmer neckband with 2 button closures, a wide self-fabric inner placket, 2 inset zippered pockets at the front waist area, long sleeves with tight fitting ribbed knit cuffs, and a tight fitting ribbed knit bottom. The garment extends to below the waist of the wearer. The garment appears to be designed for outdoor wear over other clothing for protection against the elements which is a jacket criteria. The garment is properly classified as a jacket under 6102.30.2010, HTSUS. The applicable subheading for Style WL6350 will be 6102.30.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Women’s or girls’ overcoats, carcoats, capes, cloaks, anoraks (including ski-jackets), windbreakers and similar articles, knitted or crocheted, other than those of heading 6104: of man-made fibers: other: other: women’s. The duty rate will be 28.2% ad valorem. Duty rates are provided for your convenience and are subject to change.
