Robertson, Purchasing Manager The Fairbanks Company 202 Division Street PO Box 1871 Rome, GA 30162-1871 RE: The tariff classification of a hand truck from China Dear Mr. Robertson, In your letter dated December 12, 2007, you requested a tariff classification ruling. The item under consideration is a folding hand truck (Model E-FHT-200) used to transport cargo. A photograph and specifications of the hand truck were included with your Ruling Request. The hand truck is constructed of aluminum and measures 19 inches wide by 30 inches in height with a 2 inch drop plate when folded, and 19 inches wide by 39 inches in height with a 18 inch drop plate when extended. The hand truck is equipped with two (2) 7 ½ inch semi-pneumatic, non-marking wheels. You state in your request that the hand truck has a carry capacity of 200 lbs. The applicable classification subheading for the folding hand truck (Model E-FHT-200) will be 8716.80.5010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “…other vehicles, not mechanically propelled; … parts thereof: Other vehicles: Other: Industrial hand trucks”. The rate of duty will be 3.2%. Duty rates are provided for your convenience and are subject to change. The text of the most recent Harmonized Tariff Schedule of the United States and the accompanying duty rates are provided on the World Wide Web at http://ww.usitc.gov /tata/hts/. Industrial hand trucks from China may be subject to antidumping duties or countervailing duties. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
