The sample which you submitted is being returned as requested. The item concerned is the “VIOlight Toothbrush Sanitizer” (Model VIO200). It is a battery-operated device measuring 8 ¼ inches in length, 2 ¼ inches in width and 1 inch in depth. The sanitizer is rectangular in shape, made of hard plastic and has a hinged swing door in its front. Inside the item is a 1 inch ultraviolet light bulb, a toothbrush and a removable drip tray. Located below the removable drip tray is a two-pronged rubber clasp which holds the toothbrush in place. On the back of the sanitizer is a covered battery compartment. The item operates on 2 “AA” batteries. The purpose of the item is to act as a toothbrush sanitizer. It uses ultraviolet light to sanitize. In use, the toothbrush would be placed in the sanitizer in front of the ultraviolet light, held in place by the rubber clasp. When the door of the sanitizer is closed, the ultraviolet light illuminates and the sanitization process automatically begins. The ultraviolet light turns off automatically after 7 minutes. The applicable subheading for the “VIOlight Toothbrush Sanitizer” (Model VIO200) will be 8543.70.9650, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Electrical machines and apparatus…: Other machines and apparatus: Other: Other: Other: Other”. The rate of duty will be 2.6%. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
