The tariff classification of wall clocks from China

Box 1199 Williston, VT 05495 RE: The tariff classification of wall clocks from China Dear Ms. Marcoux: In your letter dated February 3, 2006, you requested a tariff classification ruling on the Sunflower Wall Clock and the Tuscan Wall Clock from China. A picture of each clock and a sample of the Tuscan Wall Clock were submitted with the ruling request. The Sunflower Wall Clock, article number 52490, is composed of medium density fiberboard and has aluminum hour, minute and second hands. The clock contains a battery operated quartz movement. The clock measures approximately 11¾ inches in length by 11¾ inches in width and features a sunflower motif at its center. The clock requires one AA battery to operate; the battery is not included. The Tuscan Wall Clock, article number 52500, is composed of medium density fiberboard and has aluminum hour, minute and second hands. The Tuscan Wall Clock contains a battery operated quartz movement. The clock measures approximately 12 inches in length by 11¾ inches in width and features a shelf that holds three dimensional polyresin adornments. The clock requires one AA battery to operate; the battery is not included. The applicable subheading for the wall clocks will be 9105.21.80, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other clocks; wall clocks; electrically operated; other. The rate of duty will be 30 cents each plus 6.9 percent on the case plus 5.3 percent on the battery. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
