One Cross Island Plaza Jamaica, NY 11422 RE: The tariff classification of a Snow Kids ceramic votive candleholder from China. Dear Ms. Cagner: In your letter dated March 8, 2002, you requested a tariff classification ruling, on behalf of Jackel, Inc., your client. You are requesting the tariff classification on an item that is described as a ceramic votive candleholder called Snow Kids. The votive candleholder is a three dimensional depiction of two snowmen (one on either side) holding onto a Christmas tree with a gold star tree topper. The Christmas tree is green, adorned with snowflakes. The snowmen are dressed in hats, scarves and mittens in colors appropriate for the season. There are little star cut out openings scattered throughout the ceramic ornament. There is a large opening with a slot to hold a votive candle in the back of the item. The Snow Kids Christmas candleholder is classifiable in Chapter 95 of the HTSUSA as other Christmas ornaments. The sample will be returned, as requested. The applicable subheading for the Snow Kids Christmas candleholder will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Other: Other.” The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
