Dear Mr. Geiwald: In your letter dated October 5, 2001, you requested a tariff classification ruling. You are requesting the tariff classification on three models of slingshots and one pellet trap. The slingshots are described as follows: Classic II Slingshot, Model 3027, Folding Slingshot, Model 3040 and Adjustable Slingshot, Model 3061. The first slingshot, # 3027 is constructed of tempered steel and plastic with a tubular thrust band. The second slingshot, # 3040 is tempered steel in two of its parts: the yoke and the arm support. This model has a tubular thrust band and folds up for storage and travel. The third slingshot, # 3061 features a fully adjustable yoke and arm support for maximum comfort and shooting stability. As the other models it is constructed of tempered steel and plastic with a tubular thrust band. The slingshots are classifiable in Chapter 95 of the HTS as equipment for outdoor games. The pellet trap that was submitted for examination is labeled as item number 2085. The product is an all-steel construction, accepts NRA and other paper targets, and has four interchangeable silhouette animals for varying degrees of shooting difficulty. The pellet trap is classified in Chapter 93 as an accessory to a spring, an air or a gas gun. You have not requested the return of your samples. The applicable subheading for the three slingshots: Models 3027, 3040 and 3061, will be 9506.99.6080, Harmonized Tariff Schedule of the United States (HTS), which provides for “Articles and equipment for general physical exercise, gymnastics, athletics, other sports…or outdoor games…parts and accessories thereof: Other…Other.” The rate of duty will be 4 % ad valorem. The applicable subheading for the pellet trap, item number 2085 will be 9305.90.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Parts and accessories of articles of headings 9301 to 9304: Other: Of articles of subheading 9304.00.20 or 9304.00.40.” The rate of duty will be 3.9 % ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
