Dear Mr. Maher: In your letter dated June 6, 2001, you requested a tariff classification ruling, on behalf of Good Times Home Video Corp., your client. You are requesting the tariff classification on an item that is described as an exercise belt. The product is a textile belt that fits around the waist by means of a hook and loop closure. On either side of the belt is attached a plastic handle covered with foam material that is a component of the exercise device part of the item. There is a rubber cord that stretches when pulled by the user attached to each of the two handles; the rubber cord works the arm muscles of the exerciser. The sample will be returned, as requested. This product will be classified as other exercise equipment in chapter 95 of the HTS. The applicable subheading for the exercise belt will be 9506.91.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other: Articles and equipment for general physical exercise, gymnastics or athletics; parts and accessories thereof…Other.” The rate of duty will be 4.6 % ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
