Dear Mr. Basrai: In your letter dated February 27, 2001, you requested a tariff classification ruling regarding two articles. The classification of item K-GT has been issued in ruling number NY G88111. In your letter of inquiry dated May 2, 2001, you stated that you had received ruling NY G88111. Item K-SH was sent to our customs laboratory for analysis. The laboratory analysis report has been received and item number K-SH is the subject of this ruling. Item number K-SH is a circular-shaped, amber colored trivet. It has four rubber supports on the underside. Laboratory analysis reveals that the trivet has an imbricated floral pattern and measures approximately 180 millimeters (mm) in diameter. The frame is made of steel that has been painted black. The petals are made of fiberglass reinforced plastic. The report states that this item is approximately 89 percent plastic by weight. The applicable subheading for the plastic trivet, item number K-SH, will be 3924.10.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for tableware, kitchenware, other household articles…of plastics: tableware and kitchenware: other. The rate of duty will be 3.4 percent ad valorem. Articles classifiable under subheading 3924.10.5000, HTS, which are products of Pakistan are currently entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP, however, is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
