Cargo Service Building 80 JFK International Airport Jamaica, NY 11430 RE: The tariff classification of candles from China. Dear Mr. Baratta: In your letter dated February 9, 2001, on behalf of your client, The Zrike Company, Inc., you request a tariff classification ruling. You submit the following samples: Sample #SWR003, Christmas Tree Ball Ornament Candle, is a white colored candle molded in the shape of a ball ornament hung from a Christmas tree that measures approximately 3” in diameter. The candle is decorated with molded silver snowflakes and crowned on top with a silver “hanger.” Sample #SWR004, Christmas Tree Candle, is a green colored candle molded in the shape of a Christmas tree decorated with berries that measures approximately 7-1/2” in height and 3” in diameter at the base. The applicable subheading for Sample #SWR003, Christmas Tree Ball Ornament Candle, and Sample #SWR004, Christmas Tree Candle, will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for...articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: other, other. The rate of duty will be free. You have asked whether this product is subject to antidumping duties or countervailing duties.
