Dear Mr. Hoffacker: In your letter dated April 4, 2000, you requested a tariff classification ruling on ten assorted Christmas character picks, on behalf of your client Consolidated Stores, Inc. The ten samples are approximately eight inches in length and made up of the following. Four of the picks have birdhouses set in pine branches and ornamented with holly. Three of the picks have different style snowmen set in pine branches and holding miniature pine trees and holly. Two of the picks have animals sitting on pine branches and ornamented with holly and pinecones. The last pick has a Santa Claus sitting on a pine branch which is also ornamented with holly and a pinecone. The applicable subheading for the Christmas character picks will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: other: other. The rate of duty is free. Your samples are being returned to you under separate cover. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
