Hampton, Jr. & Co., Inc. 15 Park Row New York, NY 10038 RE: The tariff classification of plastic Christmas garland decorations from China. Dear Ms. Shoule: In your letter dated March 25, 1993, on behalf of F. W. Woolworth Co., you requested a tariff classification ruling. You have submitted four samples of plastic decorations, as follows: Christmas tree garlands, item nos. 19-1376, 19-1024, 19- 002 and 11-1229. This group of samples, molded-on-thread beaded garlands, meet our criteria for Christmas ornaments: the items are the proper weight, size and length (9 to 18 feet) for use on Christmas trees; the items can be hung on trees; and the items are advertised, put up for retail sale and sold as Christmas tree ornaments. Item no. 11-1229 includes eight plastic bells packaged with the garland. As requested in your letter, the samples will be returned to you. The four garlands will be classifiable under the provision for festive, carnival or other entertainment articles,..., articles for Christmas festivities and parts and accessories thereof; Christmas ornaments; other; other; in subheading 9505.10.2500, HTS. The rate of duty will be 5 percent ad valorem. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
