What is De Minimis?

A de minimis threshold is the maximum value of imported goods that can enter a country without incurring customs duties or taxes. The term comes from the legal principle de minimis non curat lex — the law does not concern itself with trifles. Most countries set these thresholds to reduce administrative burden on customs authorities and facilitate low-value trade.

In the United States, Section 321 of the Tariff Act of 1930 (19 U.S.C. § 1321) provides an $800 de minimis exemption. Shipments valued at or below $800 can enter the US informally, without paying duties, taxes, or fees. This threshold was raised from $200 to $800 in 2016 under the Trade Facilitation and Trade Enforcement Act.

Thresholds vary significantly by country. Australia exempts duties on goods under AUD 1,000 (~$650 USD), while Canada's threshold is just CAD 20 (~$15 USD). The European Union exempts duties below EUR 150 but charges VAT from the first euro. Some countries like India have no de minimis threshold at all — duties and taxes apply to all imports regardless of value.

Recent policy changes have increased scrutiny of de minimis shipments. The US is reviewing Section 321 eligibility for goods from China, Hong Kong, and Macau due to concerns about evasion of tariffs and trade remedy duties. E-commerce platforms shipping directly to consumers have driven a surge in low-value parcels that bypass traditional customs entry.
