Dear Ms. Trotta: In your letter dated March 28, 2006 you requested a tariff classification ruling. The item in question is an AM/FM clock radio that also incorporates a CD player. It is denoted as model number WCR20. It is designed for connection to an outside power source such as a wall electrical outlet. The radio is a radiobroadcast receiver that plays AM and FM broadcast channels. The radio contains an LCD digital clock that also serves as an alarm clock. The CD player does not have any recording capability but enables the user to play pre-recorded audio CDs. HQ Ruling 966989 provides guidance in the matter of classification of this type of item. Classification will be accordingly. The applicable subheading for the AM/FM clock radio with CD player will be 8527.31.6040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Reception apparatus for radiotelephony, radiotelegraphy or radiobroadcasting, whether or not combined, in the same housing, with sound recording or reproducing apparatus or a clock: Other radiobroadcast receivers, including apparatus capable of receiving also radiotelephony or radiotelegraphy: combined with sound recording or reproducing apparatus: Other: Other … Incorporating optical disc (including compact disc) players or recorders.
