Dear Mr. Heck: In your letter dated March 13, 2006 you requested a tariff classification ruling. The item in question is a wireless module, incorporating an antenna, is designed for use only with Yamaha’s music cast system. This particular module enables the user of the music cast system to operate the entire system in a wireless mode. It has both transmission and reception capability. Once attached to each component of the system the user can access prerecorded music and direct it to various locations that the components of the system are lodged. The module uses wireless WI-FI IEEE 802.11b network protocol standard that operates on the 2.4 GHz band. The module does conform to Chapter 85 Additional U.S. Note 3 as a transceiver. Classification will be accordingly. The applicable subheading for the wireless module will be 8525.20.3080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Transmission apparatus for radiotelephony, radiotelegraphy, radiobroadcasting or television, whether or not incorporating reception apparatus or sound recording or reproducing apparatus; television cameras; still image video cameras and other video camera recorders; digital cameras: Transmission apparatus incorporating reception apparatus: Transceivers: Other … Other: For frequencies exceeding 400Mhz. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
