Dear Ms. Man-Shoong: In your letter dated December 2, 2005 you requested a tariff classification ruling on 3-dimensional figure-shaped wax novelty candles. Item# R6120/21/22 Glittery Mini Star Candles set (approx. 1”H) consists of twelve star-shaped wax candles in assorted colors packed in a PVC tube. The candles are said to contain 60% palm oil. Item# R6175/76/77 Ivory Angel Candle with Gold Star (approx. 1.5”H) consists of an ivory 3-dimensional angel-shaped wax candles in assorted sizes. The candle is said to contain 60% palm oil. Item# R6179/80/81 Green Tree Candle with Black Star (approx. 1.5”H) consists of a green 3-dimensional tree-shaped wax candle in assorted sizes. The candle is said to contain 60% palm oil. The applicable subheading for the 3-dimensional figure-shaped wax novelty candles individually packed or in sets, will be 3406.00.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for candles, tapers and the like. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change. Candles from China may be subject to anti-dumping duties administered by the U.S. Department of Commerce, Import Administration.
