Clark Multinational Resources Inc. 9380 SW 72nd Street, Suite B211 Miami, FL 33173 RE: The tariff classification of mosquito coils from Guyana Dear Mr. Clark: In your letter dated October 14, 2005, you requested a tariff classification ruling. According to your letter, the subject product consists of mosquito coils containing the synthetic pyrethroid insecticide, d-allethrin (0.3% by weight), as the active ingredient. Each coil is stated to weigh 10 grams and burn for approximately 7 hours. The coils can be used indoors or outdoors. Upon being lit with a match, the coil produces a faint whiff of smoke, which disperses the insecticide. The applicable subheading for the subject product will be 3808.10.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Insecticides, … , put up in forms or packings for retail sale or as preparations or articles (for example, sulfur-treated bands, wicks and candles, and flypapers): Insecticides: Other: Other: Other.” The rate of duty will be 5 percent ad valorem. Pursuant to General Note 4(b)(i) and (ii), the subject merchandise, as a product of Guyana, is not currently entitled to duty-free treatment under the Generalized System of Preferences (GSP). The GSP, however, is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. This merchandise may be subject to the requirements of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), which are administered by the U.S. Environmental Protection Agency (EPA), Office of Pesticide Programs.
