Dear Mr. Olsen: In your letter dated March 17, 2005, you requested a tariff classification ruling. The merchandise to be imported consists of wood slats to be used as a mattress foundation for beds made in the USA. The slats will come in Twin 39” long, Full 54” long, Queen 60” long and King 72” long. All slats are 16mm (5/8”) thick and 50mm (2”) wide. All the edges are radiused and have a hole drilled at each end for attaching to the bed rail. They are dedicated parts of the mattress foundation. You have submitted photographs of the slats with your request. The applicable subheading for the wood slats will be 9403.90.7000, Harmonized Tariff Schedule of the United States (HTS), which provides for Other furniture and parts thereof: Parts: Other: Of wood.” The rate of duty will be Free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
