Box 427 801 Scholz Drive Vanadia, OH 45377 RE: The tariff classification of a gear motor from Canada. Dear Ms. Mead: In your letter dated March 5, 2004, you requested a ruling on tariff classification. The merchandise is a door actuator. The door actuator consists of a gear motor in a plastic housing. The actuator is used in an automobile to move the door located in the air channel of the climate control. The door controls the airflow, air temperature and air quality in the cabin of the automobile. The motor is a DC-motor, operating at less than 3 Watts. In your letter, you mention heading 8501.31.6000, HTS. That heading, however, does not include motors of an output not exceeding 37.5 Watts. The applicable subheading for this product will be 8501.10.4060, Harmonized Tariff Schedule of the United States (HTS), which provides for electric motors and generators, motors of an output not exceeding 37.5 W, of under 18.65 W, DC, other. The general rate of duty will be 4.4 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
