Ruling Text

U.S. Department of Homeland Security U.S. Customs and Border Protection National Commodity Specialist Division One World Trade Center, Suite 51.201 New York, NY 10007 U.S. Customs and Border Protection N365748 October 22, 2026 CLA-2-63:OT:RR:NC:CEE008:N2:349 CATEGORY: Classification TARIFF NO.: 6304.93.0000 Mr. Ryan Lickfeld Geodis USA LLC 5101 S. Broad St. Woonsocket, RI 02895 RE: The tariff classification of decorative wall hanging from China Dear Mr. Lickfeld: In your letter dated October 5, 2026, you requested a tariff classification ruling on behalf of your client, CVS Pharmacy, Inc. In lieu of a sample, photographs of the wall hanging were provided with your request. Item #805525, described as a “JOYWARD Banner,” is a decorative wall-hanging designed for seasonal home use in the spring. The wall hanging features six equally spaced polyester swallowtail-shaped pennants, each measuring 4.33 inches x 5.04 inches and bearing a shamrock design, strung along a 72-inch-long plied jute rope. The pennants have a woven face and a nonwoven backing. The shamrock design on each pennant is glued and heat pressed. Each pennant is separated by a plastic bead. Two shamrock-shaped cut-outs, each with a polyester fleece face, a polyester nonwoven backing and sponge stuffing, measuring 4.33 × 4.53 inches, are positioned at each end. Both ends of the rope feature a knotted loop for hanging. The product is sold by CVS under the JOYWARD brand. You have suggested that the wall hanging should be classified under subheading 6307.90.8500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other made up articles, including dress patterns: Other: Wall banners, of man made fibers.” We disagree. Though referred to as a banner, this item is primarily a decorative wall hanging. Alternatively, you suggest that the wall hanging banner with a shamrock design should be classified under subheading 6307.90.9891, HTSUS, which provides for “Other made up articles, including dress patterns: Other: Other: Other: Other: Other.” We disagree. For an article to be considered a made-up article of textile under subheading 6307.90.9891, HTSUS, there cannot be a more specific heading that also provides for the classification of the article. As the article is more specifically provided for in Heading 6304, HTSUS, it will be classified therein. The applicable subheading for Item #805525, described as a “JOYWARD Banner,” will be 6304.93.0000, HTSUS, which provides for “Other furnishing articles, excluding those of heading 9404: Other: Not knitted or crocheted, of synthetic fibers.” The general rate of duty will be 9.3 percent ad valorem. The duties cited above are current as of this ruling’s issuance. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided at https://hts.usitc.gov/. This ruling does not address the applicability of any additional duties, taxes, fees, exactions and/or other charges, which may apply to the goods discussed herein. This includes, but is not limited to, tariffs and other duties as provided for in Subchapter III to Chapter 99, HTSUS. Thus, for example, in addition to the classification stated above, the merchandise covered by this ruling may also need to be reported with either the Chapter 99 provision under which an additional tariff applies or one of the Chapter 99 provisions covering exceptions to such tariffs. This section states that a ruling letter is issued on the assumption that all of the information furnished in the ruling letter, whether directly, by reference, or by implication, is accurate and complete in every material respect.
