U.S. Department of Homeland Security U.S. Customs and Border Protection National Commodity Specialist Division One World Trade Center, Suite 51.201 New York, NY 10007 U.S. Customs and Border Protection N365567 October 6, 2026 CLA-2-87:OT:RR:NC:N2:201 CATEGORY: Classification TARIFF NO.: 8716.90.5060 Ms. Lauren Rochelle Kuehne+Nagel, Inc. 10001 Woodloch Forest Drive, Suite 400 The Woodlands, TX 77380 RE: The tariff classification of shopping cart parts from Canada Dear Ms. Rochelle: In your letter dated September 30, 2026, you requested a tariff classification ruling on behalf of your client, Technibilt USA dba WANZL USA, located in Newton, North Carolina. The first item has been identified as Part No. BS.APC.ASSY (Baby Seat Assembly). The Baby Seat Assembly is a molded plastic child seat insert designed for permanent installation in the area located at the front of a shopping cart. The assembly incorporates a seat flap that provides structural support and stability to the seating compartment. The component is specifically engineered for incorporation into a shopping cart and has no practical use apart from its installation as a shopping cart component. The second item has been identified as Part No. GR.APC (Shopping Cart Lower Level). The Shopping Cart Lower Level is a molded plastic platform installed on the bottom portion of a shopping cart. The component contributes to the overall structural integrity and stability of the shopping cart while also providing an additional storage area for larger merchandise. The article is specifically designed and manufactured solely for use as a shopping cart component. The third, and final, item has been identified as Part No. TB.APC (Basket Assembly). The Basket Assembly is a molded plastic part that acts as the main body of a shopping cart. It is designed to hold merchandise selected by customers while shopping. The assembly includes an upper attachment bar that secures the basket structure and provides a finished appearance. The item is specifically designed exclusively as a shopping cart component. The applicable subheading for Parts BS.APC.ASSY, GR.APC, and TB.APC will be 8716.90.5060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Trailers and semi-trailers; other vehicles, not mechanically propelled; and parts thereof: Parts: Other: Other." The general rate of duty will be 3.1 percent ad valorem. The duties cited above are current as of this ruling’s issuance. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided at https://hts.usitc.gov/. This ruling does not address the applicability of any additional duties, taxes, fees, exactions and/or other charges, which may apply to the goods discussed herein. This includes, but is not limited to, tariffs and other duties as provided for in Subchapter III to Chapter 99, HTSUS. Thus, for example, in addition to the classification stated above, the merchandise covered by this ruling may also need to be reported with either the Chapter 99 provision under which an additional tariff applies or one of the Chapter 99 provisions covering exceptions to such tariffs.
