U.S. Department of Homeland Security U.S. Customs and Border Protection National Commodity Specialist Division One World Trade Center, Suite 51.201 New York, NY 10007 U.S. Customs and Border Protection N365517 October 20, 2026 CLA-2-83:OT:RR:NC:N5:121 CATEGORY: Classification TARIFF NO.: 8309.90.0080 Blake Mattson Premier Global Promotions 7308 Aspen Lane North Brooklyn Park, MN 55428 RE: The tariff classification of stainless-steel bottle pourers from India. Dear Mr. Mattson: In your letter dated September 29, 2026, you requested a tariff classification ruling. Descriptions and photographs of the merchandise were included in your inquiry. The articles under consideration are described as three different styles of reusable stainless-steel bottle pourers. The products are inserted into a bottle neck and remain in place to dispense olive oil, vinegar, spirits, and similar pourable liquids. The first style is described as a weighted-flap pourer, item AMP102. It is a pour-through bottle spout with a straight stainless steel pouring tube, stainless steel vent tube, ribbed bottle stopper, and a hinged weighted flap at the outlet that opens when the bottle is tilted and closes when it is upright. It functions both as a pourer and as a self-closing cover for the spout while it remains inserted in the bottle. The second style is described as a tapered pourer, item A285-52. It has a stainless steel open-outlet gently angled pouring tube, vent tube, and ribbed stopper sized for standard bottles. It does not include a weighted flap or a built-in cover. The third style is described as an oversized tapered pourer, item A285-53. It has a stainless steel open-outlet gently angled pouring tube, vent tube, and ribbed stopper sized for larger bottles. It does not include a weighted flap or a built-in cover. The applicable subheading for the stainless-steel bottle pourers will be 8309.90.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Stoppers, caps and lids (including crown corks, screw caps and pouring stoppers), capsules for bottles, threaded bungs, bung covers, seals and other packing accessories, and parts thereof, of base metal…:Other: Other: Of steel. The rate of duty will be 2.6 percent. The duties cited above are current as of this ruling’s issuance. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided at https://hts.usitc.gov/. This ruling does not address the applicability of any additional duties, taxes, fees, exactions and/or other charges, which may apply to the goods discussed herein. This includes, but is not limited to, tariffs and other duties as provided for in Subchapter III to Chapter 99, HTSUS. Thus, for example, in addition to the classification stated above, the merchandise covered by this ruling may also need to be reported with either the Chapter 99 provision under which an additional tariff applies or one of the Chapter 99 provisions covering exceptions to such tariffs.
