U.S. Department of Homeland Security U.S. Customs and Border Protection National Commodity Specialist Division One World Trade Center, Suite 51.201 New York, NY 10007 U.S. Customs and Border Protection N364990 September 30, 2026 CLA-2-39:OT:RR:NC:N4:422 CATEGORY: Classification TARIFF NO.: 3924.10.4000 Katarina Nikolic Katarina Nikolic PR Nikaya Juhorska 19 Belgrade 11000 Serbia RE: The tariff classification of a plastic shaker bottle from China Dear Ms. Nikolic: In your letter dated September 10, 2026, on behalf of your client, Velomix LLC, you requested a tariff classification ruling. A photograph was submitted along with your request. The item is a plastic shaker bottle with a removable wire mixing ball, Amazon ASIN: B0CX92V78T. The plastic bottle measures approximately 7.50 inches high by 4.00 inches wide. The drinking vessel is made of polypropylene (PP) plastic, and the lid is made of polyethylene (PE). The wire mixing ball is made of stainless steel. The bottle has a removable screw-on lid, a closable drinking spout, and measurement markings located on the outside of the bottle. The plastic shaker bottle with the wire mixing ball is designed for mixing smoothies, protein mixes, and protein shakes. The volume capacity of the plastic shaker bottle is 28 fluid ounces. The user adds liquid and powdered beverage ingredients to the bottle, inserts the mixing ball, closes the lid, and shakes the bottle. The wire mixing ball moves freely inside the bottle to help mix the ingredients and break up clumps. The items are considered composite goods within the meaning of General Rule of Interpretation (GRI) 3. The plastic shaker bottle is made of plastic components and the removable wire mixing ball is made of stainless steel components. The plastic components make up the majority of the weight, bulk, and structure of the plastic shaker bottle. The plastic components provide the principal function of the shaker bottle. Therefore, it is the opinion of this office that the plastic components provide the essential character within the meaning of GRI 3(b). The applicable subheading for the plastic shaker bottle with removable wire mixing ball, Amazon ASIN: B0CX92V78T, will be classified subheading 3924.10.4000, HTSUS, which provides for “Tableware, kitchenware, other household articles and hygienic or toilet articles, of plastics: Tableware and kitchenware: Other.” The general rate of duty will be 3.4 percent ad valorem. The duties cited above are current as of this ruling’s issuance. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided at https://hts.usitc.gov/. This ruling does not address the applicability of any additional duties, taxes, fees, exactions and/or other charges, which may apply to the goods discussed herein. This includes, but is not limited to, tariffs and other duties as provided for in Subchapter III to Chapter 99, HTSUS. Thus, for example, in addition to the classification stated above, the merchandise covered by this ruling may also need to be reported with either the Chapter 99 provision under which an additional tariff applies or one of the Chapter 99 provisions covering exceptions to such tariffs.
