(Shandong, China). A description of the manufacturing process, plus a manufacturing flowchart and product photograph, accompanied your letter. The product, Frozen Roasted Garlic Cloves, is described as fresh garlic cloves that contain no additives, sugar, water, or preservatives. The cloves undergo a multi-step manufacturing process in which the fresh garlic experiences a Maillard browning reaction. The product will be imported frozen, in bulk quantities of 10 kilograms per carton, from garlic sauce manufacturing plants, and is intended for sale to the garlic sauce seasoning sector. A photograph of the product depicts the garlic cloves with a warm color gradient ranging from light honey gold to rich deep amber brown. The frozen roasted garlic cloves are said to be manufactured by first peeling and then removing the stems of raw garlic cloves. Next the cloves are cleaned with water, drained, roasted, and baked at proprietary temperature levels and durations, subsequent to being frozen at temperatures of approximately negative eighteen degrees Celsius, for importation. The oven used to manufacture the cloves is of food grade 304 stainless steel and described as having three layers, each nine meters long. Hot air enters from the bottom and exits through the top. Fresh garlic cloves are fed into the first top layer and discharged from the third layer. Roasting takes place in the first layer, while baking occurs in the second and third. The Maillard browning reaction is said to occur during the high-temperature baking process when the garlic cloves develop a crispy surface texture and golden yellow color. The applicable subheading for the Frozen Roasted Garlic Cloves will be 2004.90.8565, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: “Other vegetables prepared or preserved otherwise than by vinegar or acetic acid, frozen, other than products of heading 2006: Other vegetables and mixtures of vegetables: Other: Garlic: Peeled clove garlic, whether or not individually quick frozen.” The general rate of duty will be 11.2 percent ad valorem. The duties cited above are current as of this ruling’s issuance. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided at https://hts.usitc.gov/. This ruling does not address the applicability of any additional duties, taxes, fees, exactions and/or other charges, which may apply to the goods discussed herein. This includes, but is not limited to, tariffs and other duties as provided for in Subchapter III to Chapter 99, HTSUS. Thus, for example, in addition to the classification stated above, the merchandise covered by this ruling may also need to be reported with either the Chapter 99 provision under which an additional tariff applies or one of the Chapter 99 provisions covering exceptions to such tariffs.
