The tariff classification of Steel Liquid Containment Barriers from Germany
N361833 June 18, 2026 CLA-2-73:OT:RR:NC:N5:463 CATEGORY: Classification TARIFF NO.: 7308.90.9590 Fatima Ugalde American Lamprecht 197B Ridgeview Center, Suite A Duncan, SC 29334 RE: The tariff classification of Steel Liquid Containment Barriers from Germany Dear Ms. Ugalde: In your letter dated May 27, 2026, you requested a tariff classification ruling on behalf of your client, Anhamm Liquid Barrier Products Gmbh. Illustrative literature, product descriptions and a bill of materials were provided with your request. The products under consideration are two types of Steel Liquid Containment Barriers: The FM Fire Spillbarrier and The TÜV Chemical Spillbarrier. The Steel Liquid Containment Barriers are devices designed to prevent the uncontrolled release and spread of liquids through openings such as doorways, gates, and access areas within industrial facilities. These barriers are constructed for installation flush with the floor, positioned either in front of or within an opening where liquid containment is a critical requirement. Each barrier system comprises several key components: a movable barrier flap, robust side posts, effective sealing elements, an integrated floor housing for containment, mechanical closing mechanisms, and other necessary parts to ensure its automatic containment function. These barriers operate independently, requiring no external power sources, electrical sensors, hydraulic systems, pneumatic systems, or complex control systems. The closing function is intrinsically activated by the presence of liquid itself, ensuring a responsive and autonomous operation. In your submission, you suggest that the Steel Liquid Containment Barriers are classifiable in subheading 8479.89.9599, Harmonized Tariff Schedule of the United States (HTSUS), covering machines and mechanical appliances not specified or provided for elsewhere in the tariff. We disagree. Machines and mechanical appliances of heading 8479 are generally defined as a combination of parts that together operate on or work a material by moving it or exerting some force on such material or object. Headquarters Ruling (HQ) H329895, dated March 7, 2023 (citing HQ H250136, dated January 28, 2015). The rising liquid alone lifts the barrier’s hinge-like pivoting flap from a horizontal position to vertical position, unassisted by any gearing, motor, or other mechanical device or apparatus. In short, the barrier acts only upon itself; it does not utilize, apply, or modify energy or force, or transmit motion on another material or object to change it. Accordingly, classification of the Steel Liquid Containment Barriers in heading 8479 is precluded. The applicable subheading for the Steel Liquid Containment Barriers will be 7308.90.9590, HTSUS, which provides for structures (excluding prefabricated buildings of heading 9406) and parts of structures (for example, bridges and bridge sections, lock gates, towers, lattice masts, roofs, roofing frameworks, doors and windows and their frames and thresholds for doors, shutters, balustrades, pillars and columns) of iron or steel; plates, rods, angles, shapes, sections, tubes and the like, prepared for use in structures, of iron or steel: other: other: other: other: other. The general rate of duty will be free. The duties cited above are current as of this ruling’s issuance. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided at https://hts.usitc.gov/. This ruling does not address the applicability of any additional duties, taxes, fees, exactions and/or other charges, which may apply to the goods discussed herein. This includes, but is not limited to, tariffs and other duties as provided for in Subchapter III to Chapter 99, HTSUS. Thus, for example, in addition to the classification stated above, the merchandise covered by this ruling may also need to be reported with either the Chapter 99 provision under which an additional tariff applies or one of the Chapter 99 provisions covering exceptions to such tariffs.
