Bryant Innovative Water Care, LLC 1400 Bluegrass Parkway Alpharetta, GA 30004 RE: The applicability of tariff classification in subheading 9801.00.10, HTSUS, to U.S. Origin “E-Z Clor Enhanced Filter Cleaner & Degreaser” Dear Ms. Bryant: In your letter dated August 29, 2019 you requested a tariff classification ruling on the applicability of subheading 9801.00.10, Harmonized Tariff Schedule of the United States (HTSUS), to “E-Z Clor Enhanced Filter Cleaner & Degreaser,” a product of U.S. origin. In your submission, you state that “E-Z Clor Enhanced Filter Cleaner & Degreaser” is packaged and distributed for retail sale. This product is described as a dual-acting liquid cleaner that effectively removes scale, dirt, oil, and grease to provide better filtration for all types of residential and commercial pool filters. You describe a scenario where this product is currently in Canada and needs to be returned to the United States. There is no indication in your submission that the subject product has been advanced in value or improved in condition while abroad. On the basis of the information submitted, the subject product will be eligible for entry as American Goods Returned, provided the documentary requirements of 19 C.F.R. § 10.1 are satisfied. The applicable subheading for this product will be 9801.00.10, HTSUS, which provides for Products of the United States when returned after being exported…without having been advanced in value or improved in condition by any process of manufacture or other means while abroad. Products classified in subheading 9801.00.10 HTSUS, are free of duty. This merchandise may be subject to the requirements of the Toxic Substances Control Act (TSCA), which are administered by the U.S. Environmental Protection Agency.
