The sample will be returned to you, as requested. The submitted sample is a pair of woman’s legging style pants composed of 93 percent polyester and 7 percent spandex knit fabric. The tight-fitting, pull-on pants are lined and feature a 2 inch ribbed knit elasticized waistband, two front and back seams which create a panel extending into a gusset, and ribbed knit hemmed leg openings. The garment extends from the waist to the ankles. The applicable subheading for the pants will be 6104.63.2006, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Women’s or girls’, suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear), knitted or crocheted: trousers, bib and brace overalls, breeches and shorts: Of synthetic fibers: Other: Other: Trousers and breeches: Women’s: Containing 5 percent or more by weight of elastomeric yarn or thread. The rate of duty will be 28.2 percent. Duty rates are provided for your convenience and are subject to change.
