Dear Mr. Prata: In your letter dated September 27, 2016, you requested a tariff classification ruling. The submitted sample, identified as CVS item number 191222, the Square Wreath, consists of a square wreath measuring approximately 20” by 20” featuring small, rounded, molded plastic green leaves whose stems are fitted into wire. These green leaves completely cover the entire front of the wreath, so that the rattan base cannot be seen from the front when the wreath is hung. The plastic provides the essential character of the wreath, as it provides the total visual appeal when the wreath is hung and also predominates by cost (74%). The sample will be returned as you requested. The applicable subheading for CVS item number 191222 will be 6702.10.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Artificial flowers, foliage and fruit and parts thereof; articles made of artificial flowers, foliage or fruit: of plastics: Assembled by binding with flexible materials such as wire, paper, textile materials or foil, or by gluing or by similar methods." The rate of duty will be 8.4 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
