N279828 October 17, 2016 CLA-2-62:OT:RR:NC:N3:354 CATEGORY: Classification TARIFF NO.: 6212.90.0030 Mr. Ricky Villena Neutralogistics Customs Brokerage LLC 8578 NW 23rd Street Doral, FL 33122 RE: The tariff classification of brassiere bust cups from China Dear Mr. Villena : In your letter received August 31, 2016, you requested a tariff classification ruling on behalf of your client, Jodee Inc. Five samples were submitted with your request: three pairs of pear shaped pads, one pair of round pads and one elongated, paisley shaped pad. The pads are made from a polyurethane foam which are then covered with a knit fabric. The pear shaped samples are marked 100% nylon; however, you state that all the pads will be covered with 100% polyester knit fabric. You also state that the pads will be inserted into brassieres, although they may or may not be sewn into them.The applicable subheading for the bust cup pads will be, 6212.90.0030, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted, other, of man-made fibers or man-made fibers and rubber or plastics. The rate of duty will be 6.6 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
