Dear Ms. Bertelson: In your letter dated July 29, 2016, you requested a tariff classification ruling. The sample submitted, style 4027M, is a work glove with a palm side made of a coated knit fabric constructed of 71% plastic, 19% polyester, 10% cotton. The palm side also features an inner layer of fabric made of 53% cotton, 47% plastic. The back side of the glove is constructed from a knit fabric and features thermoplastic rubber molds which are designed for impact protection. The glove also features a hook and loop closure on the cuff, a name tag and a backside elasticized wrist. The essential character of the glove is imparted by the coated knit palm side fabric. The applicable subheading for this style will be 6116.10.4400, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Gloves, mittens and mitts, knitted or crocheted: other: without fourchettes: cut and sewn from pre-existing machine-knit fabric that is impregnated, coated or covered with plastics or rubber: other: containing over 50% by weight of plastics or rubber. The rate of duty will be 9.9 percent ad valorem. You state that the correct classification could be 6116.10.9500; however, this classification does not apply as it provides for gloves with fourchettes and this glove does not have fourchettes.
