N273123 March 14, 2016 CLA-2-95:OT:RR:NC:N4:424 CATEGORY: Classification TARIFF NO.: 9503.00.0073 Mr. Gerry Tilton Tigers (USA) Global Logistics Inc. 390 W Manville St. Compton, CA 90220 RE: The tariff classification of two scooters from China Dear Mr. Tilton: In your letter submitted February 12, 2016, you requested a tariff classification ruling on behalf of your client, Space Scooter Inc. Photographs and a description of two “Space Scooters,” model names X580 Series Regular and X360 Series Junior, were submitted with your inquiry. Both items are non-motorized wheeled scooters that can convert from the traditional kick-operated mode of operation to the unique “pump and go” mode. Using this technique, the rider rocks back and forth on the curved deck engaging the self-propulsion mechanism of the scooter which moves the rider forward. To keep or build momentum, the rider shifts his or her weight between front and back leg, in order to pump the deck and keep the wheels moving. Both models are constructed of steel and aluminum, come with hand brakes, and are foldable for easy storage. The X580 is designated for riders 8 years of age and older, weighing up to 200 pounds, while the X360 is designed for riders between 4 and 8 years of age. The applicable subheading for the two “Space Scooters” will be 9503.00.0073, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Tricycles, scooters, pedal cars and similar wheeled toys…dolls, other toys…puzzles of all kinds; parts and accessories thereof… ‘Children’s products’ as defined in 15 U.S.C. § 2052: Other: Labeled or determined by importer as intended for use by persons: 3 to 12 years of age.” The rate of duty will be Free.
