Dear Ms. Long: In your letter dated October 16, 2015, you requested a tariff classification ruling. You have submitted a photograph of an item identified as the 5 In. Halloween Tabletop EEK Sign with LED Illumination, item number 6304-05970. The article consists of an illuminated, tabletop marquee decoration composed of plastic letters attached to a rectangular base, which spell the word “EEK.” The decoration features 17 battery powered LED bulbs that can be illuminated to enhance the article. The 5 In. Halloween Tabletop EEK Sign with LED Illumination is only marketed and sold for Halloween. The applicable subheading for item number 6304-05970 will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: other: other.” The rate of duty will be Free. Duty rates are provided for your convenience and are subject to change.
