Reffue Ten Ball Labs, LLC 3 Weston Road Hingham MA 02043 RE: The tariff classification of footwear from Czech Republic Dear Mr. Reffue: In your electronic letter dated March 26, 2015, you requested a tariff classification ruling. The photographs in your electronic submission show two styles of footwear identified as Model 1 “Backyard Basic” and Model 2 “Backyard Retro.” The two styles are men’s, below-the-ankle, closed toe/closed heel, lace-up, athletic shoes with outer soles of rubber or plastics. The uppers are predominantly made of canvas textile material. The shoes have foxing or foxing-like bands. You provided F.O.B. values of over $12 per pair. The applicable subheading for Model 1 “Backyard Basic” and Model 2 “Backyard Retro” will be 6404.11.9020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for footwear with outer soles of rubber/plastics, leather or composition leather and uppers of textile materials: tennis shoes, basketball shoes, gym shoes, training shoes and the like: other: valued over $12.00/pair: for men: other. The rate of duty will be 20 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
