Dear Ms. Dudzinski: In your letter dated July 23, 2014, you requested a tariff classification ruling. As requested, the sample submitted will be returned to you. Style number 504319WMC is identified as a “16.5 inch Multi-Row Beaded Necklace” by George. The item is double strand acrylic bead and glass bead necklace with a lobster clasp closure and extension chain. The first segment is the inner row of the necklace which consists of a strand of sixteen, 8 mm purple round acrylic beads, eight, 12 mm purple round acrylic beads, seven, 14 mm round acrylic beads and eight, 12 mm hematite fac glass beads. The second segment is the outer row of the necklace which consists of a strand of twenty, 8 millimeter burgundy round acrylic beads, eight, 12 mm burgundy round acrylic beads, nine, 14 mm burgundy round acrylic beads and eight, 12 mm hematite faceted glass beads. This item when worn drapes the burgundy segment lower than the purple segment, with the hematite glass beads accenting on both segments. Review of the company provided material breakdown table, indicates that the quantity and weight of the plastic components when aggregated are significantly greater than that of the glass components when aggregated. The necklace is composed of different components (i.e. plastic and glass) and is considered a composite good. The Explanatory Notes (ENs) to the Harmonized Tariff Schedule of the United States (HTSUS), GRI 3 (b) (VIII), state that “the factor which determines essential character will vary between different kinds of goods. It may for example, be determined by the nature of the materials or components, its bulk, quantity, weight or value, or by the role of a constituent material in relation to the use of the goods.” When the essential character of a composite good can be determined, the whole product is classified as if it consisted only of the material or component that imparts the essential character to the composite good. In this instance, the material breakdown table and observation of the necklace, indicates that the plastic beads impart the essential character to the good, in that the quantity, weight and volume of the plastic beads give the appearance of a beaded necklace with metallic-like, faceted, glass bead accents. The applicable subheading for the 16.5 inch Multi-Row Beaded Necklace will be 7117.90.7500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Imitation jewelry: Other: Other: Valued over 20 cents per dozen pieces or parts: Other: Of plastics.” The rate of duty will be free. Duty rates are provided for your convenience and are subject to change.
