The products are identified as low density clear polyethylene plastic bags without handles. Pictures were provided in lieu of actual samples. You state that the bags are available in sizes ranging from 4” x 2” x 8” to 12” x 8” x 30” with a film thickness gauge of .7mils to 1.75mils. The bags have heat sealed bottoms and flat openings. The applicable subheading for the polyethylene bags will be 3923.21.0095, Harmonized Tariff Schedule of the United States (HTSUS), which provides for articles for the conveyance or packing of goods, of plastics…sacks and bags: of polymers of ethylene…other: other. The rate of duty will be 3 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
