N251763 April 4, 2014 CLA-2-:OT:RR:NC:N4:414 CATEGORY: Classification TARIFF NOS.: 9102.12.80; 9102.12.40 Mr. Giovanni Cervantes Director of International Logistics Jakks Pacific, Inc. 21749 Baker Pkwy Walnut, CA 91789 RE: The tariff classification of a wrist watch from China Dear Mr. Cervantes: In your letter dated March 20, 2014, you requested a tariff classification ruling. A sample was furnished to this office and is being returned as requested. The item is a wrist watch referred to as the Coloraid Flex Time. No model number was provided at this time. It is described as a plastic watch made of one solid piece. However, the sample provided has a one piece molded silicon watch band and case with a digital display which is a separate piece permanently affixed to the silicon. The digital display is activated by pressing an area in the bottom center of the watch face. When pressed, the time is displayed by red light emitting diodes (LEDs). After five seconds the watch display goes dark. The applicable subheading for the Coloraid Flex Time watch will be 9102.12.80, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Wrist watches, pocket watches and other watches including stop watches, other than those of heading 9101: Wrist watches, electrically operated, whether or not incorporating a stop watch facility: With opto-electronic display only: Other. The rate of duty will be free. The applicable subheading for the strap for the Coloraid Flex Time watch will be 9102.12.40, HTSUS, which provides for straps, bands or bracelets entered with watches of subheading 9102.12.80 and classifiable therewith pursuant to additional U.S. note 2 to this chapter; all the foregoing whether or not attached to such watches at the time of entry: Other. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
