Your submission included a percent by weight component breakdown and MSDS sheets for our review. Hardcoat Resin F08 consists of a solution of silicone monomers and oligomers in organic solvents. This product will be imported for use in the preparation of an abrasion resistant hard coating resin lacquer for ophthalmic lenses. Note 4 to Chapter 32, Harmonized Tariff Schedule of the United States (HTSUS), is applicable to the classification of product at issue: “Heading 3208 includes solutions (other than collodions) consisting of any of the products specified in headings 3901 to 3913 in volatile organic solvents when the weight of the solvent exceeds 50 percent of the weight of the solution.”  The applicable subheading for Hardcoat Resin F08 will be 3208.90.0000, HTSUS, which provides for Paints and varnishes (including enamels and lacquers) based on synthetic polymers or chemically modified natural polymers, dispersed or dissolved in a nonaqueous medium; solutions as defined in Note 4 to this chapter: Other. The general rate of duty will be 3.2 percent ad valorem. This merchandise may be subject to the requirements of the Toxic Substances Control Act (TSCA), which are administered by the U.S. Environmental Protection Agency.
