N249910 March 3, 2014 CLA-2-34:OT:RR:NC:2:236 CATEGORY: Classification TARIFF NO.: 3401.30.1000 Mr. Bob Butler Bert Distributing, LLC 6315 Tamarack Trail Cumming, GA 30040 RE: The tariff classification of sanitizing wipes from the United Kingdom Dear Mr. Butler: In your ruling request received January 30, 2014, you requested a tariff classification ruling on sanitizing wipes. Your submission describes the product at issue as sanitizing wipes designed to clean dirty surfaces, hands, and face. The provided MSDS describes the cleansing solution as a colorless to light-blue liquid, containing an aromatic surface-active agent and other substances. You have stated that this product’s name is “Surface Saviour” and will be imported in re-sealable retail plastic bags containing thirty-five wipes. We have determined that the wipe acts as the carrier for the impregnated cleansing solution. The applicable subheading for the sanitizing wipes will be 3401.30.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Organic surface-active products and preparations for washing the skin, in the form of liquid or cream and put up for retail sale, whether or not containing soap: Containing any aromatic or modified aromatic surface-active agents. The general rate of duty will be 4 percent ad valorem. This merchandise may be subject to the Federal Food, Drug, and Cosmetic Act and/or The Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (The Bioterrorism Act), which are administered by the U.S. Food and Drug Administration (FDA).
