Burr Blvd. Teaneck, NJ 07450 RE: The tariff classification of automotive paint primer from Japan Dear Mr. Harada: In your letter received October 18, 2013, you requested a tariff classification ruling on an automotive paint primer. You have indicated that the product at issue is polyester resin paint, identified as “ORGA P-5 (T) B-34 Paste (NPC).” The applicable subheading for “ORGA P-5 (T) B-34 Paste (NPC)” will be 3208.10.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Paints and varnishes (including enamels and lacquers) based on synthetic polymers or chemically modified natural polymers, dispersed or dissolved in a nonaqueous medium; solutions as defined in Note 4 to this chapter: Other. The general rate of duty will be 3.7 percent ad valorem. This merchandise may be subject to the requirements of the Toxic Substances Control Act (TSCA), which are administered by the U.S. Environmental Protection Agency.
