Dear Mr. Burry: In your letter dated July 9, 2013, you requested a tariff classification ruling. We are retaining the provided sample for our records. The submitted sample, “The Moto Carbide Glove,” is a full-fingered glove, with a complete palmside from fingertips to wrist, constructed of synthetic leather made from 65% polyamide, 35% polyester non- knit fabric. The palmside of the glove has a silicone grip print at the center and at the tips of the index and middle fingers. The backside of the glove is constructed of 48% polyamide, 42% polyester, 10% polyurethane knit fabric. The glove features pre-curved finger construction; fourchettes and side walls made up of finely knitted fabric; extra reinforcement on the thumb and on the backside index finger at the top; knuckle relievers to allow for flexibility; a silicone logo on the backside cuff; a thermoplastic rubber strip at the backside above the cuff; capping along the bottom; side seams; and is fastened by a thermoplastic rubber hook and loop closure over a side vent. The essential character of the glove is imparted by the synthetic leather palm. The applicable subheading for “The Moto Carbide Glove” will be 6216.00.5820, HTSUS, which provides for Gloves, mittens and mitts: other: of man-made fibers: other: with fourchettes: other. The rate of duty will be 20.7 cents per kilogram plus 10.4 percent ad valorem. You state that the gloves are used in the sport of motocross and you assert that 6216.00.4600, HTSUS, which provides for non-knit gloves of man-made fibers, specially designed for use in sports is the proper classification for the glove. There are negative factors which preclude classification as motocross gloves. The gloves lack the additional protective strips or padding at the back of the hand, which is one of the characteristics of motocross gloves. In addition, the gloves do not possess an out-seam construction. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
