Tuttle One Embarcadero Center, Suite 730 San Francisco, CA 94111-4044 RE: The tariff classification of a plastic storage bag from China Dear Mr. Tuttle: In your letter dated May 9, 2013, on behalf of Mixed Bag Designs, you requested a tariff classification ruling. The submitted sample is identified as Hold Everything, Style Number HE236. This item is a bag that is designed to be used in the home to hold and store assorted sundry items such as laundry or toys. The shell of the bag is constructed of woven strips of polypropylene (PP) onto which a thin film of PP is respectively laminated onto both sides so that both sides are visibly coated or covered. Before the lamination process is performed, the PP film is printed with a decorative motif of large purple, green and yellow flowers. When not in use, the bag can fold flat. The dimensions of the bag are approximately 24”H x 24 ½”W. There is an oblong shaped aperture near the top of each of two opposing sides that are designed to be used as handles. Based on the size of the bag, when it is full, the handles would be too far apart to hold with one hand. Consequently, two hands, one for each handle, would have to be used to carry the bag. Therefore, the handles are only designed to move the bag short distances within the home. You have suggested that this item is correctly classified in subheading 3924.90.5650 and we agree with your suggestion. The applicable subheading for Style Number HE236 will be 3924.90.5650, Harmonized Tariff Schedule of the United States (HTSUS), which provides for… household articles…of plastics: other: other…other. The rate of duty will be 3.4 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
