N240237 May 2, 2013 CLA-2-62:OT:RR:NC:N3:357 CATEGORY: Classification TARIFF NO.: 6210.40.5050 Ms. Regina Girsh Barthco International, Inc. dba OHL-International The Navy Yard 5101 South Broad St. Philadelphia, PA 19112-1404 RE: The tariff classification of men’s swimwear from China Dear Ms. Girsh: In your letter dated March 21, 2013, on behalf of A&H Sportswear Co., you requested a tariff classification ruling. The sample you submitted is being returned as you requested. The item in question, style #OM12104Y, is a pair of men’s swim trunks with a shell made from a woven 100% polyester fabric with a visible coating on the inner surface and a mesh support liner. The trunks have a fully elasticized waistband and two tabs at the center front waistband with grommets and a laced closure. The drawstring fully encircles the waist. The garment also has on-seam pockets in the front and a patch pocket with a drain hole on the left thigh. The applicable subheading for style #OM12104Y will be 6210.40.5050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other men’s or boys’ garments made up of fabrics of heading 5602, 5603, 5903, 5906 or 5907, of man-made fibers. The rate of duty will be 7.1 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
