Box 3165 Harrisburg, PA 17105 RE: The tariff classification of a shopping cart from China Dear Ms. Aldinger: In your letter dated January 30, 2013, you requested a tariff classification ruling. A picture of the article was submitted with your request. The merchandise under consideration, item number A71A0708/CN/HSF, is a shopping cart that will be used in the Rite Aid Drug Store. It features an 80 liter capacity top basket, a 60 liter capacity bottom tray, a blue plastic handle, blue plastic baby seat, blue plastic bumpers, a locking safety strap, two front casters and two rear wheels. The basket and under tray are made of gray powder-coated steel. The applicable subheading for the shopping cart will be 8716.80.5090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for trailers and semi-trailers; other vehicles, not mechanically propelled; and parts thereof, other vehicles, other, other, other. The rate of duty will be 3.2 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
