N238042 February 22, 2013 CLA-2-62:OT:RR:NC:N3:357 CATEGORY: Classification TARIFF NO.: 6202.93.5011 Ms. Ruth Hayd Kohl’s Department Stores N56 W17000 Ridgewood Drive Menomonee Falls, WI 53051 RE: The tariff classification of a women’s woven jacket from China Dear Ms. Hayd: In your letter dated January 28, 2013, you requested a tariff classification ruling. The sample you submitted is being returned to you. The item in question, style #CB23, is a women’s hip-length jacket with a shell made from a 56% nylon/44% polyester woven fabric quilted to a 2.9 oz. batting. The jacket is hip-length and has a full front opening with a four-button, right-over-left closure, a rounded collar, long sleeves without tightening, patch pockets with buttoned flaps at the waist, a 100% polyester woven lining and faux suede capping around the sleeves ends, the collar and the exposed seams on the body panels. There is no rubber or plastic application on the jacket. The jacket is a type that will be worn as outerwear for protection against the elements. The applicable subheading for style #CB23 will be 6202.93.5011, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other women’s anoraks (including ski-jackets), windbreakers and similar articles of man-made fibers. The rate of duty will be 27.7 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
