Prairie Avenue Hawthorne, CA 90250 RE: The tariff classification of a generic pouch from China Dear Mr. Gonzalez: In your letter dated October 22, 2012, you request a tariff classification ruling on behalf of your client, Sweda USA. Your sample will be returned to you. The submitted sample is a pouch constructed with an outer surface of polyester textile material. The sample was submitted without a style number. It is designed to provide organization, protection, portability, and storage to its contents. The pouch has a top opening with a self closing flap. The exterior of the pouch has a loop with a metal latch so that it may be attached to other articles. It measures approximately 3.75" (W) x 6" (H). It is of a durable construction and suitable for repetitive reuse. You have suggested classification under subheading 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS). Section XI Note (l) excludes articles of Heading 4202 from being classified within any of the Chapters of Section XI. Chapter 63 is included in Section XI. The article is akin to those of Heading 4202, HTSUS. As such, it is excluded from classification in any of the subheading of Chapter 63, HTSUS. The applicable subheading for the pouch will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other containers and cases, other, with outer surface of textile materials, of man-made fibers. The duty rate will be 17.6 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
