Jakubowski, CTCS, CCS Manager, Trade & Customs Advisory Services FedEx Trade Networks Transport & Brokerage (Canada), Inc. 7075 Ordan Drive Mississauga, ON L5T 1K6 RE: The tariff classification of transportation cabinets for housing control and network equipment from Canada Dear Mr. Jakubowski: In your letter dated October 11, 2012, you requested a tariff classification ruling on behalf of your client, Kapsch TrafficCom IVHS. The merchandise subject to this ruling is transportation cabinets that will house control and network equipment for commercial vehicle inspection systems. In its condition as imported it is a networking cabinet for Commercial Vehicle Inspection Systems. The essential components of the transportation cabinets are a pole mount kit (cabinet), 5-port Ethernet Switch - manageable (moxa), WEB I/O 12x digital input, 12x digital output Model 57630, transceiver interface module, transceiver connection module, 2-port service module, DB9 cable, USB Cable, CAT 6 cable with RJ45 connector - 1ft cat5e, fan, hose proof hood, outlet filter, inlet hose proof hood, thermostat, power supply 180W, 24VDC, power supply 180W, 48VDC, and miscellaneous hardware supplies; fuses, cabinet components, terminal blocks, wiring. The function of the transportation cabinets upon importation is that of an Ethernet Switch. The applicable subheading for the transportation cabinets housing control and network equipment for commercial vehicle inspection systems will be 8517.62.0050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Machines for the reception, conversion, and transmission or regeneration of voice, images or other data, including switching and routing apparatus: Other”. The general rate of duty will be free. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
